Title IX was passed in 1972 to protect women from exactly what San Jose State just did to Brooke Slusser.
Now SJSU got caught – and instead of apologizing, the university is suing the federal government to make sure it can keep doing it.
The left is screaming at a 23-year-old girl for telling the truth about what happened to her.
Brooke Slusser Lost Her Scholarship and Her Health After SJSU Hid a Biological Male in Her Bedroom
Brooke Slusser was a Division I volleyball co-captain at San Jose State University.
She didn't know her teammate Blaire Fleming was a biological male.
Her coach, Todd Kress, did know.
According to Slusser, Kress asked Fleming which female player he wanted to share a bedroom with on road trips – and Fleming chose Slusser.
Nobody asked Slusser.
"You're gonna let a man choose who he wants to stay in a room with, sleep with, all of these things, but not ask the woman," Slusser said in an interview with OutKick.
It got worse.
Kress also encouraged Slusser to move into an apartment – called "the villa" – with Fleming at the start of the 2023 school year.
Slusser moved in without knowing the truth.
She shared a bed, shared showers, shared her personal life with someone she was never told was biologically male.
When a news article exposed Fleming's transgender identity, Slusser found out the same way everyone else did – by reading it online.
SJSU Filed a Title IX Complaint Against Slusser for Speaking Out About Blaire Fleming
When Slusser finally spoke up about what had happened to her, the university didn't investigate.
The Department of Education's Office of Civil Rights found that another female athlete had discovered Fleming allegedly conspired with a Colorado State player to have Slusser spiked in the face during a match.
SJSU's response to that conspiracy allegation?
The school filed a Title IX complaint against the female athlete for "misgendering" Fleming.
The stress destroyed Slusser's health.
She developed severe anorexia, dropping from 160 pounds to 128 pounds in a single semester.
At 5-foot-11, the weight loss was so extreme she lost her menstrual cycle for nine months.
She dropped out of her classes.
Dropping her classes cost her Division I scholarship.
Her parents had to pay her tuition and housing out of pocket for an unfinished final semester of college.
"Those people need to have some consequences," Slusser told Fox News Digital.
San Jose State Is Suing the Federal Government to Avoid Apologizing to Slusser
Trump's Department of Education investigated and found the obvious: SJSU violated Title IX.
The department gave the school an ultimatum – sign a resolution agreement or face referral to the Department of Justice and potential loss of nearly $200 million in federal funding.
SJSU President Cynthia Teniente-Matson's response?
She sued the federal government.
"Our support for the LGBTQ members of our community – who have experienced threats and harms over the last several years – remains unwavering," Teniente-Matson said in her announcement.
Not one word in that statement about Brooke Slusser.
Now the left-wing internet is attacking Slusser for talking about it – mocking her, questioning whether anything "really happened," and demanding she stop speaking.
Former Glee actor Kevin McHale even commented publicly about Slusser's appearance.
"I would just say people that don't know my life or my trauma don't have room to say how good or bad my time at SJSU was," Slusser fired back to Fox News Digital.
Martina Navratilova, Riley Gaines, Sen. Tommy Tuberville, and XX-XY Athletics founder Jennifer Sey all came to Slusser's defense.
"Brooke has every right to feel violated," Sey wrote. "She was lied to. She would not have agreed to room with or play with a man."
The Supreme Court Could End San Jose States Transgender Athlete Policy in June
The case isn't over.
Colorado District Judge Kato Crews – a Biden appointee – dismissed charges against the Mountain West Conference but kept alive the Title IX claims against SJSU and the California State University system.
He then deferred his ruling on those remaining claims until the Supreme Court decides West Virginia v. B.P.J., a case on whether states can ban biological males from competing in women's sports.
The Supreme Court heard oral arguments on January 13, 2026.
Court watchers came away with one clear read: the conservative majority looked ready to side with West Virginia.
Slusser's attorney Bill Bock told Fox News he expects that ruling to be a win for women's sports – and a direct boost to Slusser's case against SJSU.
Here's what fires me up about this story.
SJSU knew exactly what it was doing.
The coach knew Fleming was a biological male.
He arranged the roommate situation anyway – and asked the male athlete who he wanted to sleep near, not the woman.
When the woman spoke up, the school punished her.
When the federal government found them guilty, the school sued to keep doing it.
They're spending millions of dollars in legal fees right now to avoid apologizing to Brooke Slusser.
And Democrats in Congress are backing them.
Title IX was written in 1972 to protect women like Brooke Slusser from institutions that prioritize men over women.
San Jose State just handed Trump the perfect case – a female athlete destroyed physically, academically, and financially by an institution that chose a biological male over her at every single step.
The Supreme Court ruling comes in June.
Every university in America hiding biological males in women's private spaces is watching that clock tick down.
