Rand Paul Just Handed Anthony Fauci the Consequences He Never Saw Coming

Anthony Fauci spent five years hiding behind media protection and Democrat cheerleading.

Now Rand Paul has his contempt referral at the Justice Department – and Ron Johnson has his phone.

The Senate panel just handed Fauci the bill for 111 rounds of "I plead the Fifth" – and the answer is coming whether he talks or not.

Fauci Took the Fifth More Than 100 Times and Got Hit With Contempt Anyway

Last week, Fauci sat before the Senate Homeland Security and Governmental Affairs Committee under subpoena and refused to answer a single question.

Not one.

He invoked the Fifth Amendment 111 times on questions about gain-of-function research, COVID origins, the Wuhan lab, and what he knew and when he knew it.

Chairman Rand Paul had already stripped away Fauci's excuse: Biden's preemptive pardon, signed January 19, 2025, covered only conduct through that date – anything Fauci said under oath in 2026 fell entirely outside it.

Paul made the stakes plain before the vote: "We are voting on whether a witness who has received the benefit of a sweeping federal pardon can be ordered by this committee to answer questions – and then defy that order without consequence."

The 8-5 party-line vote said yes, there are consequences.

Paul didn't send it to the full Senate – he hand-delivered the referral directly to the attorney general the same day.

No delay.

No political games.

Straight to DOJ.

The Phone Changes Everything

While Fauci was busy stonewalling, Ron Johnson's Permanent Subcommittee on Investigations quietly obtained a forensic copy of the government-issued iPhone Fauci carried throughout his time leading NIAID.

HHS Secretary Robert F. Kennedy Jr. – who has spent years calling out Fauci's protection of the pharmaceutical industry – signed off on the transfer.

The phone covers the critical pandemic years when Fauci was privately acknowledging concerns that COVID-19 may have been genetically engineered, even as he publicly dismissed the lab leak theory as a fringe conspiracy.

Rand Paul's committee already released over 1,100 pages of Fauci's personal diary from 2019 to 2022.

Johnson and Paul together obtained millions of additional pages from federal databases.

Now they have the phone.

"Hopefully, this device will address many of the questions he refused to answer at last week's hearing," Johnson said.

Every text message Fauci sent.

Every call log.

Every email on that device.

He chose 111 rounds of "I plead the Fifth" – and the senators asking the questions now have his phone.

Fauci Walked Into a Trap He Built Himself

This is not a witch hunt.

This is a man with a federal pardon who decided that pardon was a shield against any accountability whatsoever – and got it wrong.

Paul made the distinction precise: the committee wasn't judging Fauci's pandemic decisions or his years of television appearances – it was deciding whether any witness can ignore a lawful congressional order without facing consequences.

Congress has used contempt referrals before – House Republicans held Eric Holder in contempt in 2012 when he stonewalled Fast and Furious documents, and Democrats used it aggressively against Trump allies during the January 6 investigation.

The precedent cuts both ways.

Now it cuts toward Fauci.

More than a million Americans died during COVID.

Millions more suffered long-term effects that altered their lives permanently.

The American people were told the lab leak was dangerous misinformation by the same man who privately wrote in February 2020 that scientists in Wuhan "are known to have been working on gain-of-function experiments."

That email exists.

Now that phone is in Republican hands.

Fauci could have answered the questions.

He chose 111 rounds of "I plead the Fifth" instead – and Rand Paul just made sure that choice has consequences.
