Obama Built the Birth Tourism Loophole in 2009 and Biden Handed China the Keys
In 2009, Obama's Homeland Security Secretary Janet Napolitano created a categorical parole program giving Chinese nationals access to the Commonwealth of the Northern Mariana Islands – a U.S. territory in the Pacific, just north of Guam – without a standard tourist visa.
No consular interview. No State Department vetting. Just a flight from the mainland and a U.S. birth certificate waiting at the end of it.
The results were immediate and staggering. Births to Chinese mothers in the Northern Mariana Islands jumped from fewer than 10 in 2009 to nearly 600 by 2018 – a 5,900 percent increase. By 2012, Chinese tourist births had already outnumbered births to the indigenous American population on the islands.
Airlines began requiring pregnancy tests before boarding flights to Saipan.
Then Biden made it worse. In his final months, Biden's DHS finalized the Economic Vitality and Security Travel Authorization Program – the EVS-TAP – extending visa-free entry to mainland Chinese nationals for 14-day stays in the Northern Mariana Islands. No visa interview. No consular screening. An online form and a plane ticket.
Senators Rick Scott, Jim Banks, and Markwayne Mullin called it a "clear and significant national security risk" and demanded the Trump administration shut it down.
The Manchurian Generation: CCP-Raised American Citizens Who Can Vote in 2030
The mechanics of what Obama and Biden built are worth understanding, because this isn't just about birth certificates.
Once a child is born on American soil in Saipan, the mother takes the U.S. passport and flies back to China – where the child grows up entirely inside the CCP's school system, absorbing its version of American history and values.
Investigative author Peter Schweizer, whose book The Invisible Coup debuted at number one on the New York Times bestseller list, estimates Chinese nationals have produced between 750,000 and 1.5 million U.S. citizen children this way over the past 15 years.
The federal government has no idea how many, because U.S. birth certificates don't record the citizenship of the parents.
Schweizer calls them the "Manchurian Generation" – American citizens on paper, CCP products in practice. When they turn 18, they can vote in U.S. elections, donate to political campaigns, and apply for federal jobs where Mandarin fluency is treated as an asset. Senators Scott, Banks, and Mullin warned explicitly that within a decade, these individuals could be applying for sensitive positions inside the U.S. federal government.
China industrialized this strategy. Schweizer found 107 Chinese-owned surrogacy companies operating in Southern California alone. A Wall Street Journal investigation uncovered a single CCP-linked Chinese national who had fathered over 100 American-born children through surrogates – all raised in Communist China with full U.S. citizenship rights.
Chip Roy and Tom Tiffany Demand a Count of CCP-Linked Anchor Babies on US Voter Rolls
This week, Reps. Chip Roy of Texas and Tom Tiffany of Wisconsin, joined by 32 other House Republicans, sent a letter to Homeland Security Secretary Kristi Noem, Secretary of State Marco Rubio, and Interior Secretary Doug Burgum demanding a full accounting.
Roy was blunt: "American citizenship is a sacred trust – not a loophole to be exploited."
The lawmakers want hard numbers: How many children have been born in the Northern Mariana Islands to at least one Chinese national parent since 2009? How many have already reached voting age? How many are currently registered to vote in the United States? Do any have documented ties to the Chinese Communist Party?
These questions have never been answered – because no administration before Trump ever demanded them.
The loophole has been sitting wide open for 17 years. Obama cracked the door. Biden tore it off the hinges. China walked through and built a citizenship pipeline on American soil, and your federal government wasn't just asleep at the wheel – it was handing out the visa waivers.
The 14th Amendment was written to protect freed slaves after the Civil War. Democrats turned it into a factory for CCP-linked American passports. Trump is the first president in a generation to look at what's been built and demand that someone answer for it.
