House passes Kayla Hamilton Act after bitter Democrat opposition
The Kayla Hamilton Act passed the House 225 to 201 this week — requiring federal authorities to conduct background checks on unaccompanied illegal alien minors before releasing them to sponsors.¹
Only seven Democrats crossed party lines to support the bill named after 20-year-old Kayla Hamilton, who was raped, tied up, and strangled to death by Walter Javier Martinez — a 17-year-old MS-13 gang member who entered the country illegally as an unaccompanied minor.²
Martinez was sentenced to 70 years in prison this past April after prosecutors detailed how the Biden administration released him to a sponsor despite gang tattoos and a criminal record in El Salvador.³
The legislation introduced by Rep. Russell Fry, R-S.C., requires the Department of Health and Human Services to assess whether unaccompanied alien children pose safety risks before placement — a simple phone call to El Salvador would have revealed Martinez's gang affiliation and kept him in a secure facility.⁴
Democrats fought the bill tooth and nail.
Rep. Luz Rivas, D-Calif., claimed it "undermines and strips critical rights from vulnerable children" and "subjects children as young as 12 to strip searches."⁵
Fry fired back that medical evaluations already occur when minors enter the country — the bill simply requires checking for gang tattoos during those existing examinations.
Tammy Nobles — Hamilton's mother — wasn't buying the Democrat excuses for one second.
Kayla Hamilton's mother destroys Crockett's "random dead person" smear
Nobles told Fox News Digital she's "so over the Democrat officials stating that the Republican Party is using Kayla's story as a political stunt."⁶
Democrats like Rep. Jasmine Crockett dismissed Hamilton as a "random dead person" during House Judiciary Committee debate on the bill in September.⁷
Crockett — who just launched a U.S. Senate bid in Texas — accused Republicans of exploiting Hamilton's death for "political expediency."⁸
Nobles made crystal clear that Democrats don't get to rewrite her daughter's story.
"Everything regarding Kayla and the Kayla Hamilton Act was what her mom wanted," Nobles stated. "I made it very clear in the beginning that I wanted a law in her name."⁹
The frustrated mother explained the Biden administration's failure was inexcusable.
"All that the Department of Homeland Security and Department of Health and Human Services had to do was make one phone call to El Salvador," Nobles said. "They would have known that Walter Javier Martinez was an MS-13 gang member, and that he had a criminal record of illicit gang activity."¹⁰
Fry called Crockett's "random dead person" comment "not only cruel, it revealed a deeper unwillingness shared by numerous Democrats to acknowledge the real human cost of failed border and child placement policies."¹¹
The Biden-Harris policies that killed Kayla Hamilton
A May 2023 House Judiciary Committee investigation exposed exactly how the Biden administration failed Kayla Hamilton.
Martinez crossed the border illegally in March 2022, fell into HHS custody, and got handed off to a U.S. sponsor shortly after — all without anyone checking his body for gang tattoos or picking up the phone to call El Salvador about his record.¹²
"The Committee's and Subcommittee's oversight has revealed that the Biden Administration insufficiently vetted Kayla's murderer and allowed him to enter the country," the report stated.¹³
Sheriff Jeffrey Gahler of Harford County, Maryland — where Hamilton was murdered — blasted Crockett for "dismissing Kayla Hamilton's tragic murder."
"This random dead person was a young woman with her whole life ahead of her who was brutally murdered in our community by an illegal immigrant/MS-13 gang member," Sheriff Gahler said.¹⁴
Hamilton's mother testified before Congress about her daughter's murder and joined President Trump at campaign rallies and press conferences throughout his 2024 campaign.
She described Kayla as talking "a mile a minute, like a hummingbird" who loved animals, dreamed of becoming a veterinarian, and "lived every day to the fullest."¹⁵
"To prevent such tragedies from happening again, the Kayla Hamilton Act will mandate background checks on unaccompanied minors and the sponsors, so that no person will be at risk," Nobles said.¹⁶
The legislation now heads to the Senate where it will be led by Sen. John Cornyn, R-Texas — ironically, the same Senator that Crockett hopes to defeat in 2026.
"No one else should ever again have to suffer the way my daughter Kayla did," Nobles added. "The Biden-Harris Administration's policies prioritized the comfort of illegal aliens, like Kayla's murderer, over the safety of innocent Americans."¹⁷
