The WNBA called Trump's executive order a "bad-faith" attack on their league.
Now a former NBA player just declared for their draft with a law firm backing him up.
And Matt Gaetz just filed WNBA draft papers for former NBA star Royce White and the League has no answer.
The Letter That Broke the WNBA's Silence
Matt Gaetz isn't in Congress anymore, but he's still making Democrats miserable.
On Monday, Gaetz Law sent a formal declaration letter directly to the WNBA league office on behalf of Royce White, a former NBA player who appeared in exactly three games in the league before washing out more than a decade ago.
The letter cited Article XIII, Section 1(a) of the WNBA's own 2026–2033 Collective Bargaining Agreement – the one the league signed in March – which states that "only players who are women are eligible to play in the WNBA."
The problem for the league is that nobody in that CBA ever bothered to define the word "women."

White identifies as a transgender woman for purposes of basketball eligibility, and under the WNBA's own language, Gaetz argues his client qualifies.
"Royce White changed how the NBA thinks about player mental health," Gaetz told Fox News Digital. "Now Royce White is an inspirational voice for Black transexual lesbians everywhere who aspire to play in the WNBA."
The League Is Trapped by Its Own Policy
The WNBA spent weeks dodging this moment.
When Indiana Fever star Sophie Cunningham said in July that "young girls in sport who shouldn't have to go against biological men," the league called it a distraction.
When Cunningham doubled down – "I said what I said" – the league stayed quiet.
When a task force of team presidents and general managers finally met on August 12 to address the mounting pressure, they left without adopting a single new eligibility rule.
The league's official statement afterward was a masterpiece of institutional cowardice.
"There are no immediate eligibility matters affecting the WNBA, and we strongly denounce the bad-faith efforts to use these topics to demean or marginalize others," a WNBA spokesperson said.

Matt Gaetz filed the paperwork.
White told Fox News Digital he is prepared to sue if he goes undrafted and unsigned.
"I have to file a discrimination lawsuit, right? I mean, that's ridiculous," White said. "We're gonna have to have a huge legal battle about discrimination if I can't play."
White said only one thing can end it: the WNBA making a definitive public statement about biological males playing in the Women's Association.
The league won't do that.
They know what happens legally when they do.
The Trap the WNBA Set for Itself
This was preventable.
When the WNBA and WNBPA negotiated their collective bargaining agreement in March 2026, every other major sports organization was already hardening its language.
The LPGA updated its eligibility rules in 2024 to require athletes be assigned female at birth or transition prior to male puberty.
The NCAA banned biological males from women's sports the day after Trump signed his executive order in February 2025.
The Supreme Court upheld state laws restricting transgender women from women's sports earlier this year.
The WNBA watched all of this happen and still signed a 409-page CBA that addresses women's eligibility in exactly one sentence and defines nothing.
Legal analysts who have reviewed the CBA say the league is now exposed.
The WNBA's only credible defense – arguing that being biologically female is a "bona fide occupational qualification" for its product – requires them to say publicly what they refuse to say publicly.

White knows this.
Gaetz knows this.
And every general manager in that task force meeting knows this.
The WNBA built this trap and now Royce White and Matt Gaetz just walked through the door.
Now they either define "women" in public – and hand conservatives the explicit victory they've been demanding – or they stay silent, get sued under their own CBA, and let a federal court do it for them.
Sophie Cunningham saw this coming in July.
