Record numbers of illegal aliens have entered the country on Joe Biden’s watch.

But Biden is trying to make the situation even worse.

And Joe Biden is furious after Chief Justice John Roberts issued a last-minute ruling against his open borders agenda.

Put in place by Donald Trump in 2020, Title 42 allows Border Patrol agents to quickly return illegal aliens back to their home countries after arriving at the border.

Without Title 42, even Biden officials admit an additional half a million illegal aliens could cross the border each month, which is the equivalent of the population of Atlanta, Georgia.

According to Andy Biggs (R-AZ), roughly 30,000 illegal aliens will cross the border per day without Title 42 in place.

But the Biden administration was planning to end Title 42 on December 21 after a Democrat-appointed judge ruled against it in November.

However, on Monday, 19 Republican Attorneys General formally asked the Supreme Court to keep Title 42 in place by issuing a stay on the lower court’s decision.

The Attorneys General wrote:

“A district court judge in Washington, DC struck down Title 42, a Trump-era rule that allows the rapid expulsion of aliens who pose a public health risk. When the Biden Administration announced its intention to abandon its defense of Title 42, the multistate coalition tried to intervene to allow the states to continue to defend this important policy despite the Biden Administration’s dereliction of duty. The district court judge refused to rule on the motion, so the coalition appealed, urging the higher court to stay the district court’s ruling.”

The U.S. Court of Appeals for the District of Columbia denied the motion to intervene late last week. Now, the coalition is petitioning the U.S. Supreme Court to stay the district court’s ruling and stop the scheduled termination of Title 42 on December 21.

Within hours of receiving the request, Chief Justice John Roberts issued an administrative stay keeping Title 42 in place while the Justice Department files its brief.

Even though Biden plans to end Title 42, it will remain in place as long as the issue is pending appeal in federal court.

The case is Arizona v. Mayorkas, No. 22A544 in the Supreme Court of the United States.

Dan Stein, the President of the Federation for American Immigration Reform (FAIR), spoke about the importance of Roberts’ decision, saying, “The American people . . . were spared even greater hardship at the hands of the Biden administration by the U.S. Supreme Court’s eleventh hour stay.”

Of course, Justice Roberts’ stay is only temporary while the appeal plays out in court.

But as Stein noted, it “is a welcome reprieve” that spared Americans from greater hardships for the time being.
