Joe Biden buried a government kill switch inside every new American car.
Congress just voted to defund it – and the Freedom Caucus is cheering.
Here is what Biden never wanted you to read about the mandate he tucked into a trillion-dollar bill.
The Surveillance System Biden Snuck Into Your Driveway
In 2021, Biden signed the so-called Infrastructure Investment and Jobs Act.
It was a $1.2 trillion spending bill.
Most Americans thought they were getting roads and bridges.
What they also got was Section 24220 – the HALT Drunk Driving Act – buried deep inside the legislation.
The law ordered the National Highway Traffic Safety Administration to write new rules requiring automakers to install passive impairment detection technology in every new vehicle sold in America.
That means a system monitoring your driving performance, scanning for blood alcohol at or above the legal limit, and preventing vehicle operation whenever the algorithm decides you are impaired.

The government mandates the hardware.
The government sets the detection standard.
The government defines what counts as impaired enough to stop your car from starting.
NHTSA missed its own November 2024 deadline to issue the rule – because no commercially available technology yet meets the law's passive detection standard.
The agency told Congress in a February 2026 report that existing systems do not meet the required accuracy levels.
The mandate is still on the books.
Congress Takes the Keys Back
On Wednesday, Rep. Michael Cloud (R-TX) had enough.
Cloud, along with Rep. Celeste Maloy (R-UT) and even one Democrat – Rep. Marie Glusenkamp Perez (D-WA) – offered an amendment to the Transportation, Housing and Urban Development appropriations bill to defund the kill switch mandate entirely.
The House Appropriations Committee adopted it 33 to 26.
Freedom Caucus Chairman Andy Harris called it exactly what it is.
"The federal government controlling your car in the name of safety is straight-up dystopian," Harris told Breitbart News. "Americans want freedom – not Big Brother riding shotgun."

Cloud was equally direct.
"Taxpayer dollars should not fund a surveillance system that treats every law-abiding American driver as a suspect," Cloud said. "We cannot allow our Constitutional liberties to be shredded or create a world where every American driver becomes a node for data gathering."
Rep. Andrew Clyde (R-GA) added: "The government should never have the authority to take control of Americans' cars. Kill Switch technology is a dystopian nightmare that we must forcefully reject and defeat at every turn."
MADD CEO Stacey D. Stewart called the vote a defeat for victims of drunk driving and claimed the amendment was built on "inaccurate claims."
Nobody asked MADD why solving drunk driving requires planting government-mandated monitoring hardware in the cars of every law-abiding American on the road.
This Is Not About Drunk Driving
This fight is not actually about drunk driving.
It is about whether the federal government gets to plant monitoring hardware inside every American vehicle – hardware that logs your behavior, evaluates your fitness to drive, and reserves the right to stop you.
Biden knew that framing it as a safety measure was the only way to get it through Congress.
Republicans who initially opposed it were told they were voting against saving lives.
Nineteen Republicans voted to keep it funded in January 2026 when Rep. Thomas Massie offered a similar defunding amendment that failed.
Those same Republicans voted to let a government-mandated algorithm decide whether Americans can leave their driveways.
The Freedom Caucus has been fighting this battle on multiple fronts simultaneously.

Last month, Harris cheered an Appropriations amendment closing the data broker loophole – stopping federal agencies from purchasing Americans' browser histories and location data without judicial oversight.
Two weeks ago, Harris drew the same line on FISA surveillance, demanding warrant requirements before the government can sweep up American communications.
The kill switch fight is the same fight.
Washington, DC is systematically building surveillance infrastructure into every corner of American life – your car, your phone, your financial transactions – and labeling each piece of it a safety measure.
This 33-26 committee vote is the first time Congress has actually defunded any piece of that architecture.
The amendment still has to survive a full House floor vote, a Senate battle, and a conference process before it becomes law.
Biden's kill switch is not dead yet – but for the first time, it is bleeding.
