President Joe Biden is working to systematically dismantle the successful border security policies put in place by former President Donald Trump.
The “Remain in Mexico” policy was one of the most effective strategies pursued by the Trump administrations to stop illegal aliens.
The Migrant Protection Protocols (MPP), referred to as the “Remain in Mexico” policy was implemented in 2019.
The policy requires that illegals trying to seek asylum in the U.S. wait in Mexico until their case is heard by a federal immigration judge instead of detaining them or releasing them into the country.
Illegals could make phony asylum claims that could take years for overworked judges to hear while disappearing into the country.
In 2020, 72% of asylum claims were considered bogus confirming that illegals are using asylum to game the system to get into the U.S.
President Biden suspended the “Remain in Mexico” policy his first day in office and the Department of Homeland Security officially ended it in June 2021.
Republican Attorneys General in Texas and Missouri won a federal lawsuit to keep the policy in place in August 2021.
But the Biden regime has tried to try to fight the court ruling to carry out its scheme to end the policy.
Homeland Security Secretary Alejandro Mayorkas admitted that the policy “likely contributed to reduced migratory flows” but it did so “by imposing substantial and unjustifiable human costs on the individuals who were exposed to harm while waiting in Mexico.”
The case was appealed to the U.S. Supreme Court, which ruled that the Biden regime had the authority to terminate the policy.
The Court sent the case back down to the District Court to determine whether the regime violated the Administrative Procedure Act, which determines how federal agencies can implement policy changes.
Now, the judge in that case handed Joe Biden a major legal setback in his quest to end the “Remain in Mexico” policy.
U.S. District Judge Matthew Kacsmaryk for the Northern District of Texas ruled that the Biden regime’s efforts to end “Remain in Mexico” are put on hold until the rest of the legal process can play out.
Texas Attorney General Ken Paxton, who brought the lawsuit, celebrated the legal victory on social media.
“I sued Biden nearly 2 yrs. ago to keep Remain-in-Mexico,” Paxton said. “The Admin played games all the way to SCOTUS, but tonight Texas & USA WINS.”
Paxton has filed numerous legal challenges to Biden’s reckless border policies.
“I just secured an order from a federal court ordering Biden not to scrap the program,” Paxton added. “Biden’s open-border agenda won’t survive my legal attacks.”
The court ruling is a major setback to Joe Biden’s effort to throw the southern border wide open for illegals.
