Donald Trump Just Found the Perfect Way to End the Foreign Student Work Visa Scam

Joe Biden spent four years expanding a program ICE just proved was running 500 fake employees out of a building with three real workers.

Now Trump is shutting the whole racket down.

And Biden's own DHS can't explain why they kept growing a program that investigators found was riddled with phantom employees and offshore money schemes.

The Racket ICE Exposed

The Optional Practical Training program was sold to America as a simple idea: let foreign students get a year of work experience after graduation, then go home.

That's not what it became.

ICE Director Todd Lyons stood before cameras in May and said what everyone in Washington already knew but nobody would say out loud.

OPT became a "magnet for fraud."

The program that was supposed to serve a few thousand students a year ballooned into 419,000 foreign workers flooding the American labor market – with zero congressional authorization.

Bush created it by executive fiat.

Obama expanded it.

Biden expanded it further – while his own DHS was receiving reports of phantom employees and doing nothing.

And the whole time, big corporations quietly pocketed a tax break that American workers never get – companies hiring OPT workers don't pay Social Security or Medicare taxes on those employees.

ICE's investigators went to the 25 largest OPT employers and found fake employer networks, offshore managers cutting checks from abroad, and money flows that didn't add up.

In one case, 500 students listed their employer as a business that claimed to have three workers.

Lyons called it "the tip of the iceberg."

What Trump Is Proposing

After federal courts blocked a $100,000 fee on H-1B visas last month, the administration immediately started looking for another angle.

They found one.

Unlike H-1B visas, which Congress created by statute, OPT was built entirely by regulation.

DHS made it up in 1992 and expanded it twice without Congress ever voting on it.

That regulatory origin gives DHS far more legal flexibility over OPT than over H-1B.

So the administration is now weighing a $100,000 fee on the OPT program itself – the entry point into the entire foreign student pipeline that feeds into H-1B slots and eventually green cards.

A DHS spokeswoman confirmed the discussions are real: "At DHS we are always having conversations about how to use all tools in our arsenal to protect the integrity of our legal immigration system."

The White House didn't deny it either.

And if you're wondering who's really panicking, look at who's been recruiting the most OPT workers: Amazon, Google, Microsoft, Meta.

These are the same companies that opposed the H-1B fee, got the rules narrowed, and then watched a federal appeals court block even the narrowed version on July 24.

The American Workers Nobody Talks About

Here's what the corporate media won't say.

OPT doesn't just bring in foreign workers – it specifically bypasses the H-1B caps Congress put in place to protect American workers.

That cap exists for a reason.

Congress set a limit on how many foreign workers could compete with American STEM graduates.

OPT lets corporations ignore that number entirely.

And the workers paying the price are American STEM graduates who can't find jobs in their own fields – jobs being filled by OPT workers whose employers save money on payroll taxes while doing it.

Senator Chuck Grassley spent years sending letters about the shell employers and fabricated records – and Biden's DHS ignored every single one.

ICE didn't.

Now DHS is weighing whether to price the scam out of existence with a $100,000 fee that even the largest shell company operations couldn't absorb.

The Heritage Foundation and the Center for Immigration Studies have both documented what the program actually became: an uncapped, unregulated backdoor to the American labor market that Congress never approved and corporate America spent decades exploiting.

Trump isn't targeting students.

He's targeting a racket – one that displaces American workers, skips payroll taxes, floods the labor market through a loophole no one in Congress ever voted for, and generates enough fraud that ICE investigators found 500 "employees" at a business that had three actual workers on payroll.

That's not a student visa program.

That's a pipeline – and Trump just proposed the toll booth.
