Trump DOE Title IX Investigation Finds SJSU Violated Women's Rights
The Department of Education didn't mince words in their findings.
San Jose State violated Title IX by forcing female athletes to compete against and share facilities with biological male Blaire Fleming.
The school knew exactly what they were doing – and silenced anyone who dared speak up.
Trump's team gave SJSU until February 11 to comply with a list of demands, including issuing personal apologies to every woman who played with or against Fleming from 2022-2024.
Brooke's parents released their first public statement since the ruling – and they're thrilled someone finally held the school accountable.
"We're watching closely to see how they respond, and our next step is to fight for justice in court," they said.
"San Jose State and the Mountain West Conference betrayed the volleyball team, and they will have to answer for it."
Parents Watched Daughter Develop Eating Disorder After Trans Athlete Lawsuit
Brooke transferred to SJSU from Alabama in 2023, excited for a fresh start.
Instead, she got roomed with Fleming on team trips without being told Fleming was male.
When Brooke discovered the truth and joined a lawsuit against the NCAA in September 2024, the backlash was swift and brutal.
Students screamed at her on campus.
One girl in an elevator told her friend she should have slapped Brooke "when she had the chance."
The stress consumed her physically and mentally.
Brooke developed severe anorexia, dropping from 160 pounds to 128 in a single semester.
At 5-foot-11, that weight loss was dangerous – and she lost her menstrual cycle for nine months.
Her grades collapsed under the pressure.
When winter break came, Paul and Kim saw what their daughter had been hiding and told her point-blank she wasn't going back to San Jose.
"You can go get your stuff next summer when your lease is up, and stay here," Paul told her.
Brooke tried to finish her classes online from Texas, but couldn't handle it – she dropped them weeks into the spring semester.
That decision cost her the Division I scholarship, and Paul and Kim had to pay the full semester's tuition and housing out of pocket.
"We had to pay, basically her mortgage and her apartment for the rest of the semester," Paul said.
"So it was a pretty large financial burden on us when that happened."
They paid thousands because their daughter couldn't safely return to campus after telling the truth.
SJSU Gave Transgender Athlete Scholarship While Retaliating Against Female Players
The Department of Education's investigation uncovered what Brooke's parents already knew.
SJSU didn't just allow Fleming to compete – they gave Fleming special treatment at the expense of female players.
Fleming got a full scholarship over multiple female athletes who were passed over.
When assistant coach Melissa Batie-Smoose filed a Title IX complaint defending the women on her team, SJSU suspended her and fired her weeks later.
Batie-Smoose had reported allegations that Fleming conspired with an opposing player to have Brooke spiked in the face during a match.
The Mountain West Conference investigated and predictably found "insufficient evidence" – wrapping up interviews just three days before closing the case.
Brooke and her teammates lost the one coach who made them feel safe.
"After we found out that she was released, a lot of the team just kind of broke down," Brooke told Fox News Digital months earlier.
"Even one of my teammates was like, 'I don't feel safe anymore,' because there's no one now that we feel like we can go and talk to."
Seven players entered the transfer portal after the 2024 season.
Trump Administration Title IX Ultimatum: SJSU Must Apologize to Female Athletes
The Education Department's five demands don't leave wiggle room.
SJSU must adopt biology-based definitions of male and female – and acknowledge that biological sex is unchangeable.
The school must separate sports and intimate facilities based on biological sex going forward.
They must restore individual records to female athletes that Fleming took from them.
They must send personalized apologies to every woman who competed with or against SJSU while Fleming was on the roster.
And they must publicly commit to never delegating Title IX compliance to outside groups like the NCAA – who created this mess.
SJSU's response was predictably evasive: "We remain committed to providing a safe, respectful, and inclusive educational environment for all students while complying with applicable laws and regulations."
Translation: We're reviewing our options and hoping this blows over.
It won't.
Paul and Kim Slusser made clear they're taking the fight to court – and with Trump's DOE backing them up, SJSU just lost its biggest excuse.
"We're thrilled that the Trump administration, Secretary McMahon, and the Department of Education are taking action on the issue of men in women's sports – something the last administration did not do," the Slussers said.
The Biden administration spent four years enabling this insanity – expanding Title IX protections to include "gender identity" and threatening schools that didn't comply.
Trump reversed course on day one of his second term, defining sex as biological and immutable for federal law purposes.
He directed the Department of Education to crack down on schools violating women's rights.
SJSU became one of the first targets, along with the University of Pennsylvania and the Massachusetts Interscholastic Athletic Association.
Trump's team has opened 18 investigations total into schools and districts in blue states that allow males to compete in girls' sports.
The message is crystal clear: this administration won't tolerate the abuse of female athletes to protect a radical agenda.
Brooke Slusser's parents watched their daughter's health destroyed, her education derailed, and their family bank account drained – all because San Jose State refused to acknowledge basic biology.
Now Trump's making sure the school pays for it.
