How Biden Judges Are Weaponizing Flight Risk Rules To Block Trump Deportation Operations
U.S. District Judge Mustafa Kasubhai blocked ICE from making warrantless arrests in Oregon unless agents prove each illegal immigrant is a flight risk.
The Wednesday ruling forces agents to file paperwork for every single arrest explaining why that specific person might run before they can get a warrant.
Biden nominated Kasubhai in September 2023 after Republicans warned his record was so extreme he shouldn't be confirmed.
Democrats rammed him through anyway on a party-line 51-44 vote in November 2024.
Now he's doing exactly what they installed him to do – tie ICE's hands while criminals walk free.
The judge ordered agents to document every future warrantless arrest with detailed justifications including location, community ties, and specific facts supporting flight risk.
He called ICE operations "violent and brutal" and claimed agents denied due process during immigration raids.
Victor Cruz Gamez became the poster child for this ruling after getting detained during a traffic stop last October.
He's a 56-year-old grandfather who's been in the U.S. since 1999 – that's over two decades without securing legal status.
Cruz Gamez had a driver's license, work permit, and pending visa application but spent three weeks in detention anyway before a lawyer secured his release.
Here's what the judge won't tell you – this is the system working exactly as Democrats designed it.
You apply for something, anything, and suddenly you're untouchable no matter how long you've been here illegally.
The ruling blocks warrantless arrests going back to September 2025 and certified it as a class action.
That means thousands of illegals in Oregon can now claim the same protection.

Oregon isn't alone.
On the same day, judges in Minnesota and Pennsylvania issued similar rulings blocking Trump's enforcement operations.
Judge Susan Richard Nelson in Minnesota ordered the immediate release of a Mexican national who's lived in the U.S. since 1988 with a pending green card application.
In Pennsylvania, Judge Harvey Bartle slammed ICE for acting "contrary to law" after arresting a Brazilian man during a routine check-in appointment.
These aren't isolated incidents – they're a coordinated legal assault designed to protect the millions Biden invited in.
The rulings share identical DNA: Biden-appointed judges, immigrant advocacy groups filing lawsuits, and claims that enforcing immigration law violates due process.
Democrats created sanctuary cities to shield illegals from federal law.
Now their judges are creating sanctuary courtrooms to finish the job.
Federal law says agents can arrest and detain any alien who illegally entered the country or overstayed their visa.
That's been the law for decades until activist judges started rewriting it from the bench.
Judge Kasubhai's background tells you everything about why he made this ruling.
He spent years representing workers' compensation claims and union members before becoming a judge.
Democrats loved his speeches praising diversity, equity and inclusion as "the heart and soul of the court system."
Republican Senator Ted Cruz warned during confirmation hearings: "Many Biden nominees have been extreme, but your record is so far out of the mainstream that you have attracted virtually all of the questions."
Senator Mike Lee grilled him on those DEI comments.
Kasubhai responded that "access to justice" and treating everyone with "dignity" was at the heart of his work.
That sounds noble until you realize he's extending those protections to people who broke into the country illegally.
The Trump administration responded to similar judicial interference by suing Maryland federal judges who issued automatic stays blocking deportations.
DHS spokesperson Tricia McLaughlin said the pattern of judicial overreach "undermines the democratic process and cannot be allowed to stand."
She's right – but that won't stop Democrat judges from issuing more rulings just like this one.
Every ruling that blocks ICE arrests means more time for illegals to disappear into the interior.
Every procedural requirement means fewer arrests ICE can physically accomplish with limited resources.
Every "individualized assessment" means mountains of paperwork that slow enforcement to a crawl.
The lawsuit in Oregon was brought by Innovation Law Lab, a nonprofit that exists solely to obstruct immigration enforcement.
Their executive director Stephen Manning called the ruling a "catalyst for change" and claimed it's about "asking the government to follow the law."
That's rich coming from groups whose entire mission is helping people who broke the law stay in the country.
This ruling creates an impossible situation for ICE agents in the field.
They encounter someone they have probable cause to believe is here illegally.
Now they need to stop, conduct an "individualized assessment" of whether that person might flee, document their reasoning, and report it to the court.
By the time they finish that paperwork, the illegal immigrant is gone.
Which is exactly the point.
Judge Kasubhai made one thing clear in his ruling about ICE agents: "Due process calls for those who have great power to exercise great restraint. That is the bedrock of a democratic republic founded on this great constitution. I think we're losing that."
Fine words from a judge who just stripped ICE of the tools they need to enforce laws Congress actually passed.
Trump's DHS has arrested roughly 220,000 people since he returned to office in January 2025.
The Oregon ruling will be appealed but that takes time.
Meanwhile, ICE operations in Oregon are effectively paralyzed.
This is the hill Democrats have chosen – protecting illegal immigrants from the consequences of breaking our laws.
Their judges are the enforcement mechanism.
And Trump's going to have to fight them in court for every single arrest.
