Joe Biden’s lawless agenda continues to run into a brick wall in the federal judiciary.
Judges continue to step in over Biden’s Constitution-shredding power grabs.
And a federal judge just smacked down Joe Biden with this brutal defeat.
U.S. District Judge Matthew Kacsmaryk blocked Joe Biden’s attempt to turn millions of Americans into felons overnight if they don’t register their pistol braces – a commonly owned firearms accessory – with the government and pay a tax.
Judge Kacsmaryk rejected the idea that the rule wasn’t violating the Administrative Practices Act.
“The Court is certainly sympathetic to ATF’s concerns over public safety in the wake of tragic mass shootings. The rule embodies salutary policy goals meant to protect vulnerable people in our society,’” Kacsmaryk wrote.
“Public safety concerns must be addressed in ways that are lawful. This rule is not,” Kacsmaryk added.
Judge Kacsmaryk wrote that the Biden administration didn’t take into account the harm they would inflict on pistol brace manufacturers as they would have to close their doors as the rule would impose costs of up to $1 billion.
“Additionally, ATF admits the 10-year cost of the Rule is over one billion dollars, and because of the Rule, certain manufacturers that obtain most of their sales from the stabilizing braces risk having to close their doors for good,” Kacsmaryk continued.
Judge Kacsmaryk also pointed out that a pistol brace didn’t turn an everyday pistol into a short barreled rifle – which Americans can only own after obtaining a federal license – and that the administration didn’t even bother to address this fact.
“The ATF provided no explanations for how the agency came to these classifications, and there is no ‘meaningful clarity’ about what constitutes an impermissible stabilizing brace,” Judge Kacsmaryk’s opinion read.
Democrats like Joe Biden pay lip service to claims that they support the Second Amendment.
That is not the case at all.
Their actions tell the real story and every time a gun-grabber like Joe Biden gets their hands on the levers of power there is an unrelenting assault on the right to keep and bear arms.
One of Joe Biden and the Democrat Party’s ultimate political goals is banning and confiscating every firearm in America.
Turning gun owners into criminals with the stroke of a pen is certainly part of that plan.
